1. Acceptance of Terms

By accessing or using JanvAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

JanvAI provides AI-powered design visualization services, including but not limited to:

• Interior room redesign and style transformation
• Exterior facade and architectural style visualization
• Garden and outdoor landscape design
• Credits-based generation system with subscription options

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Verify your email address to activate your account
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

4. User Content

Your Photos

You retain ownership of photos you upload. By uploading photos, you grant JanvAI a limited license to process and transform them to provide our services.

Acceptable Use Policy (AUP)

These rules apply to uploaded images, prompts, generated images, and any content shared through JanvAI. You must not upload, request, generate, or distribute:

• Sexual or NSFW content: pornography, explicit sexual activity, sexualized nudity, or non-consensual intimate imagery.
• Violence or gore: graphic injuries, mutilation, torture, or content promoting or threatening violence.
• Hate speech: content that promotes hatred, dehumanization, discrimination, or violence against people based on protected characteristics such as race, ethnicity, religion, disability, sex, or sexual orientation.
• Child-unsafe content: child sexual abuse material (CSAM), sexualization or exploitation of anyone under 18, grooming, or depictions of child abuse. This includes AI-generated, fictional, and altered imagery.
• Deepfakes or impersonation: deceptive synthetic depictions of real people, unauthorized use of another person’s likeness, or content falsely suggesting their identity, actions, statements, or endorsement.
• Copyright or trademark infringement: content you lack the rights or permission to use, including unauthorized reproduction of protected works or deceptive use of brands and logos.
• Illegal activity, malicious code, fraud, harassment, defamation, privacy violations, or attempts to bypass safety checks or account restrictions.

Content Moderation

Uploaded images undergo an automated NSFW check before generation. Images flagged as sensitive are rejected; generation does not proceed when this check is unavailable. Automated checks can make mistakes and do not guarantee detection of every prohibited category or review of every generated output.

We may review reported content and relevant account or task information to investigate misuse and apply these rules. Do not attempt to evade moderation. Report prohibited outputs even if an automated check did not block them.

Enforcement Actions

Depending on severity and recurrence, we may reject a request, restrict or remove access to content, issue a warning, suspend generation privileges, or terminate an account. Serious abuse, including child exploitation, may result in immediate suspension without prior warning. We may preserve relevant evidence and report suspected illegal activity to competent authorities where required by law. You may contact us to request a review of an enforcement decision.

Report Content or Appeal a Decision

Email support@janvai.com with the subject “Content report” or “Moderation appeal”. Include the task ID or page URL, the reason for your report or appeal, and a way to contact you. Do not attach or redistribute suspected CSAM; provide identifiers or links instead. Reports and appeals can be submitted without a JanvAI account.

5. AI-Generated Content

Designs generated by our AI are provided for visualization purposes. You receive a license to use generated designs for personal and commercial purposes (within your subscription tier), subject to these Terms and applicable third-party rights. JanvAI uses FLUX and Google Gemini models for image generation. Third-party models remain the property of their respective owners. See our AI model disclosure.

6. Subscription and Payment

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method for all fees incurred.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you'll retain access until the end of your current billing period. No refunds are provided for partial periods, except as required by law or at our discretion.

Price Changes

We may change subscription prices with 30 days' notice. Continued use after price changes constitutes acceptance.

7. Intellectual Property

JanvAI’s software, website, and content, and the third-party models used by the Service, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

8. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind. JanvAI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that AI-generated designs will be accurate, suitable for your purposes, or achieve any particular result. Designs are for visualization only and should not replace professional advice.

9. Limitation of Liability

To the maximum extent permitted by law, JanvAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless JanvAI and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by applicable laws, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration, except that either party may seek injunctive relief in court.
